A lot of these are lowQ since I either start with lowQ photos or they're just done quickly because they're for lolz.

Only if used in a manner than generates revenue. So using it for ads or selling it. You can do whatever you want with most images as long as you're not using it for personal gain.

It would be settled as an individual case if taken to court. The argument being whether or not it is classified as Fair Use. Those involved then looking at four specific aspects of the case. Character and purpose of the use, nature of the reproduction, amount used (basically if it was all ripped or if only a piece is used), and impact on value.

Basically they ask what's it used for? Profit or nonprofit? And how much has it been changed?
SHOULD the work be public domain (specifically nonprofit)? Meaning does it add to society in some way/does it have a substantial purpose that would be limited should it be confined.
How much of it was used? Was it the whole image? Just a piece?
And how does it affect the product's value? Does it diminish the value of the product in some way?

And even if it went through and the prosecutors managed to convince the judge that it is NOT fair use, the claim of parody and satire comes into play. Opening a whole new can of worms.

Essentially, there's a good chance that the judge will not rule against the photo, but there is a chance but it would have to be taken to court.

What if (an I know it doesn't apply in this case) someone edited a picture of someone to put them in a bad light (defame them)? Like edited in a cigarette or worse?

If it was straight up damaging then it would likely be ruled against and removed. If it were, as I said before, defended under the parody and satire bit of fair use, it would get more complicated. If it's something such as the join meme or something like that, it would probably be counted as satire.

A good example of satire/parody are the "nudes" shops a lot of people do. Either editing the face of a celebrity or otherwise onto a nude photo, or editing breasts/genitals onto a photo of said celebrity. This is parody and usually cannot be removed by whoever is in the photos unless it becomes severely and apparently damaging to their reputation, which is difficult to prove if their twitter follower count goes UP as a result of it rather than down. If the photo is intended to defame, though, it's usually pretty obvious, like the individual claiming that it's real in an attempt to damage the person.

And most of the time it's not worth going to court to have it removed because of all the money it costs.

The internet and fair use is a foggy and dangerous place to say the least.

Most content creators don't, myself included. I've had my logos and edits ripped and sold. Had to threaten legal action against one t-shirt company if they didn't remove one of my logos.

I look at it like this. Am I selling it and am I hurting someone? If I feel that I am not hurting anyone and I know I'm not receiving any kind of monetary reward I'll go ahead and do it/post it. But I am a strong believer in removing things upon the request of the owner/subject of the image.
So if Conor, Pandi, Nath, Gary, Del, or any of the many people I've shooped asked me to remove images of them, I wouldn't hesitate to do so.

That's always a good thing. Sorry for picking, Just curious I guess, and I never did understand how all this sh*t works. I remember I use to get bombarded with abuse over recolouring. I can't imagine that's any different

To put the conversation to rest: If it's not making you money and not hurting anyone, they can f*** off. It's up to you if you want to remove it (and also up to the company that owns the site it's posted on because they can make decisions regarding fair use for their own safety.)

I can do pretty well any edits you'd ever need. Face shoops, touchups, image alterations (such as color correction, lighting, etc), full creation shoops (making an image out of a bunch of other images). So anything you ask for, I can pretty well do. I'm just not the best freehand artist.

It's not that hard once you understand the tools with which you're working. It just takes practice, and I've got seven or eight years of practice under my belt.

With those kind of editing skills, maybe you should take up photography. Create some really great art.

I've been tempted, but the field it so thoroughly saturated that I don't feel it would really go anywhere. Which is why I keep it as a hobby and don't really strive to refine my skills and instead am studying software engineering.

Idk, a lot of people would pay a lot of money to have their photo taken and edited, especially if was more than just your usual touch ups.
